1. Ownership of rights

All artworks, images, illustrations, texts, design and other content displayed on this website are the work of Silvia Biscaia and are protected by copyright.

The protection of these works arises from the Portuguese Code of Copyright and Related Rights (Código do Direito de Autor e dos Direitos Conexos) and from applicable international conventions, namely the Berne Convention.

2. Reservation of rights

The reproduction, copying, distribution, public communication, transformation, exhibition, editing, transmission or any other use, in whole or in part, of the works and content of this website, by any means whether physical or digital, is not permitted without the prior written authorisation of the artist.

This prohibition includes, among others:

  • The reproduction of images of the artworks in any medium;

  • The use of the artworks for commercial or advertising purposes;

  • The creation of derivative products (prints, merchandise, NFTs, etc.);

  • The use of the images to train artificial intelligence systems.

3. Sale of original artworks and copyright

The purchase of an original artwork grants the buyer ownership of the physical work, but does not transfer the copyright in it. The artist retains all economic and moral rights, including the right of reproduction and of communicating the image of the work, unless otherwise agreed in writing.

The artist's moral rights (in particular the right to authorship and to the integrity of the work) are inalienable and cannot be waived.

4. Authorised use

5. Trademarks and names

The name "Silvia Biscaia", the logo and any distinctive signs associated with the artist may not be used without her express consent.

This website may contain links to third-party sites, for which the artist is not responsible. The inclusion of such links does not imply any association with or approval of their content.

7. Limitation of liability

The artist makes every effort to keep the information on the website up to date and accurate but does not guarantee the absence of errors or interruptions. The colours and details of the artworks shown on screen may vary slightly from the original works, due to the characteristics of each device.

8. Infringement of rights

The unauthorised use of the artworks and content constitutes an infringement of copyright and may give rise to civil and criminal liability under the law.

9. Governing law and jurisdiction

This legal notice is governed by Portuguese law. Without prejudice to the mandatory rights of consumers — who may bring proceedings before the courts of their place of residence and resort to alternative dispute resolution through the centres listed on the Portuguese Consumer Portal (www.consumidor.gov.pt) — the courts of the district of Faro shall have jurisdiction for any other disputes.
